Terms of Service

1. Acceptance of Terms

By accessing or using Trend Trakr ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Eligibility

The Service is intended for licensed real estate professionals. You must be at least 18 years old and legally able to enter into contracts. By using the Service, you represent that you meet these requirements.

3. Account Registration

To use the Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activity under your account

4. Subscription and Payment

Free Trial

New users receive a 30-day free trial. No payment information is required to start the trial. At the end of the trial period, you must subscribe to continue using the Service.

Paid Subscription

After the free trial, you may subscribe to a monthly ($20/month) or annual ($192/year) plan. Subscriptions automatically renew unless cancelled. All payments are processed securely through Stripe.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. No refunds are provided for partial billing periods.

Refunds

All sales are final. We do not offer refunds except as required by law or at our sole discretion.

5. Permitted Use

You may use the Service to:

  • Create market reports for your real estate clients
  • Share reports with clients via public links
  • Export reports as PDFs
  • Customize branding (logo, colors, themes)

6. Prohibited Use

You may NOT:

  • Share your account credentials with others
  • Resell or redistribute the Service
  • Scrape, copy, or reverse engineer the Service
  • Use the Service for illegal purposes
  • Upload viruses, malware, or malicious code
  • Violate any applicable laws or regulations
  • Impersonate another person or entity

7. Content and Data

Your Content

You retain ownership of any content you upload (logos, branding). By using the Service, you grant us a license to use your content to provide the Service.

Market Data

Market data provided by the Service is for informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of market data. You are responsible for verifying data accuracy before sharing with clients.

Public Reports

Reports shared via public links are accessible to anyone with the link. Do not include confidential client information in shared reports.

8. Intellectual Property

The Service, including all software, designs, and content (excluding your uploaded content), is owned by Trend Trakr and protected by copyright, trademark, and other intellectual property laws.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, error-free, or secure. Market data may contain errors or inaccuracies.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TREND TRAKR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Trend Trakr from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or a prominent notice on the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of British Columbia.
